Court win for low-paid Domino’s workers in underpayment class action

Domino’s Pizza could pay significant compensation after a landmark Federal Court ruling in favour of franchise workers.

The federal court found the pizza giant misled franchisees when it ordered them to underpay thousands of drivers and in-store staff under outdated employment agreements over five years that excluded key entitlements.

The ruling follows a class action brought by former Domino’s delivery driver Riley Gall in 2019, alleging underpayment of wages under the Australian Consumer Law for loss caused by misleading and deceptive conduct. Gall said this verdict wasn’t just a win for him, as it always has been about justice for the thousands of others who were exploited and not paid the amount that they deserved under the correct award, because many of them will still be in those positions where the money will really help.

Lawyer for the plaintiff Brett Spiegel said the judgment gave Domino’s franchise employees “the justice they deserve”.

The class action covers delivery drivers and in-store workers employed by Domino’s Australian franchisees between 2013 and 2018. A further hearing will be held to decide group member claims.
